Michigan's OWI/OWVI Laws

If you have been charged with drunk driving, you are not alone. It is pretty common for people to be arrested for driving under the influence. In Michigan the legal limit is .08. It is easy to blow a .08 or more on a Breathalyzer — after just a few beers. By blowing over the limit, you can be charged with Operating While Intoxicated (OWI) or the lesser offense of Operating While Visibly Impaired (OWVI).

Facing the Consequences of a Drunk-Driving Arrest

Things have become so much tougher for people arrested for drunk driving in the last 10 or 15 years:

  • If you're arrested for drunk driving, you're going to jail for the night.
  • For a first offense, your license is suspended for 90 days.
  • You will also be facing a fine. The fine varies by community, but it typically ranges from $500-$1000 in addition to a state fine.
  • You may have to serve jail time if you're convicted.
  • Your insurance rates will increase significantly.

Attorney Dan Gerow can provide a powerful defense in drunk-driving cases. He will work to have the charges reduced or dropped, to limit the sentence, or to have you acquitted at trial. He will also get started right away to help you obtain a restricted license for driving to and from work and in the course of your employment.

We may be able to prove mistakes or inaccuracies during your field sobriety testing. We may also be able to have your OWI reduced to an OWVI, which lessens the impact on your insurance rates.
